De facto partners have rights — and gaps — you should know.
You've been living with your partner for years. You're not married or in a civil union.
Without a clear Will
- After 3 years, a de facto partner generally has relationship-property rights — but inheritance under intestacy can still be uncertain and slow.
- Under 3 years, your partner may receive little or nothing without a Will.
With a Will
- You make your intentions unmistakable, whatever the length of the relationship.
- You avoid your partner having to prove the relationship in a stressful process.
Practical guidance for NZ
- If you own a home together, check whether it's owned as 'joint tenants' (passes automatically) or 'tenants in common' (passes via your Will).
