We have young children
Guardianship is the decision most parents haven't made.
Emma and Jack have two kids under 10. Like most parents, they've talked about 'sorting a Will one day'.
Without a clear Will
- If both parents die without naming a guardian, the Family Court decides who raises the children.
- Relatives may disagree about who should step in — during the worst week of the children's lives.
- Money left to children is managed by the court's default rules, not your instructions.
With a Will
- You name a testamentary guardian to care for your children if you can't.
- You can set how and when children receive money (for example, at 20 or 25 instead of 18).
- You choose someone to manage that money — and a backup.
Practical guidance for NZ
- Talk to the person before naming them — make sure they're willing.
- Name a backup guardian in case your first choice can't act.
- Consider a small 'letter of wishes' about how you'd like your children raised.
