Will by YesOrNo is an educational tool. It is not legal advice and not financial advice, it creates no professional relationship, and you use it entirely at your own risk. For anything beyond a simple estate, please see a lawyer or trustee company.

1. Educational information only

Will by YesOrNo ('the Service') is an educational tool that helps you understand how Wills work in Aotearoa New Zealand and prepare a personalised checklist and reference materials to get ready to write your own Will. The Service produces a preparation checklist, not the Will itself. All content, guidance, examples, checks, scores and generated documents are provided for general information only.

The Service does not know your full circumstances and cannot account for everything that may affect you.

2. Not legal advice

Will by YesOrNo is not a law firm or a trustee company. Nothing provided by the Service is legal advice, and no solicitor–client or other professional relationship is created by using it. The 'legal check', 'confidence score' and any warnings are automated, general prompts — not a legal opinion, and not a guarantee that a document is valid, complete or suitable for you.

Wills law is detailed and fact-specific. You should obtain advice from a qualified New Zealand lawyer or trustee company before relying on any Will — and you must do so for anything beyond a straightforward estate, including (without limitation) trusts, businesses, farms, overseas assets, relationship-property issues, blended families, potential claims or disputes, or if anyone may be inadequately provided for.

3. Not financial advice

The Service is not a financial adviser and does not provide financial, investment, tax, insurance, KiwiSaver or accounting advice. Any references to money, assets, values or distributions are illustrative only. Obtain advice from an appropriately licensed professional before making financial decisions.

4. Use at your own risk

You use the Service, and any document you generate with it, entirely at your own risk. You are solely responsible for the accuracy of the information you enter, for the choices you make, and for ensuring any Will is correctly signed and witnessed under the Wills Act 2007 (New Zealand).

A document generated by the Service has no legal effect unless and until it is printed and validly signed by you and witnessed by two independent adults who are present at the same time, and who receive nothing under the Will.

5. No warranty

The Service is provided 'as is' and 'as available', without warranties of any kind, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose, or that the Service will be uninterrupted or error-free.

To the extent you are acting in trade, the guarantees in the Consumer Guarantees Act 1993 are excluded.

6. Limitation of liability

To the maximum extent permitted by law, Will by YesOrNo and its contributors will not be liable for any loss, damage, cost or expense (including any indirect or consequential loss, and any loss arising from a Will being invalid, incomplete, challenged or misunderstood) arising out of or in connection with your use of, or reliance on, the Service.

Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993 or other law that cannot lawfully be excluded.

7. Your privacy and your data

The Service is designed so that the information you enter is not collected, transmitted to, or stored by us. Your answers are held only in your own web browser (in local storage) on your device, so they persist between visits on that browser until you clear them.

Because your data stays on your device, it is your responsibility to keep it secure and to erase it (using the 'Erase my data' control, or by clearing your browser data) on shared or public devices. We cannot recover data that is lost or cleared.

8. Intellectual property

The Service, its content and its design are protected by law. You may generate and use a Will document for your own personal purposes. You may not otherwise copy, resell or redistribute the Service or its content without permission.

9. Third-party links

The Service may contain links to third-party websites and resources. These links are provided for your convenience only. We do not control, endorse or take responsibility for the content, products or practices of any third-party site, and their inclusion does not imply any association with, or endorsement by, us (or vice versa).

You access any linked site at your own risk, and we are not liable for any loss or damage arising from your use of it.

10. Changes

We may update the Service and these terms from time to time. Continued use after a change means you accept the updated terms. Legal information can become out of date as legislation changes; always confirm the current position with a professional.

11. Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction.
